1. Acceptance of Terms

By accessing or using Bink DFS (the "Service"), operated by Bink Analytics LLC ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms.

2. Description of Service

Bink DFS is a Daily Fantasy Sports (DFS) lineup optimization platform. The Service provides tools for generating, analyzing, and managing DFS lineups for use on third-party DFS platforms such as DraftKings. The Service includes free and paid subscription tiers with varying feature access.

3. Eligibility

You must be at least 18 years of age (or the age of majority in your jurisdiction, whichever is greater) to use the Service. By using the Service, you represent and warrant that you meet this age requirement.

You are responsible for ensuring that your use of the Service complies with all applicable federal, state, and local laws and regulations, including but not limited to laws governing Daily Fantasy Sports in your jurisdiction. The Service is not available in jurisdictions where DFS contests are prohibited by law.

4. Account Registration

To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for safeguarding your account credentials and for all activity that occurs under your account.

You agree to notify us immediately at support@binkdfs.com if you become aware of any unauthorized use of your account.

5. Subscriptions and Payments

Bink DFS offers both free and paid subscription plans. Paid plans are billed on a weekly, monthly, or seasonal basis as selected at the time of purchase. All payments are processed through Stripe, a third-party payment processor.

Recurring Billing: By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis at the applicable rate until you cancel. Weekly and monthly subscriptions automatically renew at the end of each billing period.

Season Pass: Season pass purchases are one-time payments covering the duration of the NFL season (approximately 22 weeks). Season passes are non-recurring and do not auto-renew.

Cancellation: You may cancel your subscription at any time through the Settings page or by contacting us at support@binkdfs.com. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.

Refund Policy: All subscription fees are non-refundable except as required by applicable law. If you believe you were charged in error, contact us at support@binkdfs.com within 7 days of the charge.

Price Changes: We reserve the right to change subscription prices at any time. Price changes for existing subscribers will take effect at the start of the next billing period following notice.

6. No Guarantee of Results

THE SERVICE IS AN ANALYTICAL TOOL ONLY. Bink DFS does not guarantee any financial outcome, winning lineup, or positive return on any DFS contest entry. Player projections, ownership estimates, lineup optimization, and all other data provided by the Service are estimates based on statistical models and publicly available information.

You acknowledge and agree that:

DFS contests involve significant risk of financial loss.
Past performance of our models does not guarantee future results.
Projections and recommendations may be inaccurate.
You are solely responsible for your DFS contest entries and any associated financial outcomes.
The Company is not a financial advisor and the Service does not constitute financial advice.

7. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose or in violation of any applicable laws.
Share, resell, or redistribute your account access or any data obtained from the Service.
Attempt to reverse engineer, decompile, or extract source code from the Service.
Use automated scripts, bots, or scrapers to access the Service beyond normal use.
Interfere with or disrupt the integrity or performance of the Service.
Circumvent any access restrictions, rate limits, or tier limitations.
Create multiple accounts to circumvent free tier limitations.

8. Intellectual Property

All content, features, functionality, algorithms, models, software, and design of the Service are owned by Bink Analytics LLC and are protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial DFS purposes during your active subscription.

You may export lineups generated by the Service for use in DFS contests. You may not redistribute, sell, or publicly share bulk lineup data, optimization algorithms, or projection methodologies derived from the Service.

9. Third-Party Services

The Service integrates with or references third-party platforms including but not limited to DraftKings, Stripe, and data providers. We are not affiliated with, endorsed by, or responsible for any third-party platform. Your use of third-party services is governed by their respective terms and policies.

10. Service Availability

We strive to maintain the availability of the Service but do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any losses resulting from service interruptions.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BINK ANALYTICS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless Bink Analytics LLC, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or in connection with your use of the Service, your violation of these Terms, or your violation of any applicable law.

13. Termination

We reserve the right to suspend or terminate your account at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. Sections 6, 8, 11, 12, and 14 shall survive termination.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in the State of New York.
